Xopuntech India Private Limited is a duly incorporated company as per applicable laws in India having its registered office at Guwahati, Assam, India, (hereinafter referred to as "we," "us", or "our"). We, inter alia, provide software and technical services to clients in India and abroad ("Services"). This privacy policy ("Privacy Policy") explains how we collect, use and share information when you use our website(s) and/or Services (hereinafter referred to as "Site"). Any references to "you", "your" or "User" shall mean any person or entity using our Site. We will not use or share your information with anyone except as described in this Privacy Policy.
This Privacy Policy sets out our personal information collection and sharing practices for our Site and through the other channels described below. By using or accessing our Site, you agree to the collection, use and disclosure of information in accordance with this Privacy Policy. Notwithstanding anything to the contrary stated herein, for users of XT Academy, the Privacy Policy as available on the portal of XT Academy would be applicable. If you do not agree with the terms and conditions of this Privacy Policy, please do not use or access the Site.
We respect your right to privacy and will only process personal information about you or provided by you in accordance with the "Data Protection Legislation" which for the purposes of this Privacy Policy shall mean: (i) the Digital Personal Data Protection Act, 2023 read with the rules made thereunder ("DPDP Act"); (ii) Information Technology Act, 2000 read with the rules made thereunder including but not limited to Information Technology (Reasonable security practices and procedures and sensitive personal data or information) Rules, 2011, as may be amended and modified from time to time ("IT Act"); (iii) the retained EU law version of the General Data Protection Regulation ((EU) 2016/679) ("UK GDPR"); (iv) the General Data Protection Regulation ((EU) 2016/679) ("GDPR"), or (v) any other national laws, regulations and secondary legislation, as may be applicable to the relevant jurisdiction in relation to the Site or the specific Services being provided to you by us, and then (ii) any successor legislation to the foregoing legislations and other applicable privacy laws.
For the purposes of this Privacy Policy, the following capitalized terms shall have the meaning as ascribed to them hereinafter.
We may collect Personal Data about you from either our correspondence, or basis your use of our Site, including information procured form cookies and analytics. In limited cases, and with due prior notice, we may collect and store sensitive personal data about the User, including bank account details for payments.
We only intend to use your personal information for legitimate interests towards improving our Services, the website interface and to gain insights from the pattern of use case and service requirement and market our Services, or pursuant of our legal obligations, if any. If you wish to have you personally identifiable information that you have provided to us deleted, you can always do so by sending a request to us on the e-mail id of our Grievance Officer provided at the bottom of this page. You may note that deletion of certain Personal Data may lead to cancellation of your registration with the Site and your access to certain features of the Site. In case you have availed any paid Services from us, in case such cancellation affects any paid feature or Service, please note, we shall not be liable to make any refund to you in this regard.
We will use our best efforts to negotiate in good faith and settle any dispute that may arise out of or relate to this Privacy Policy or any breach of it, and any escalating dispute or claim relating to or connected with it (including non-contractual disputes or claims) shall be governed by and construed in accordance with the laws of India and the courts of Guwahati, India are the only place where disputes or claims relating to or connected with this Privacy Policy (including non-contractual disputes or claims) may be decided.
Changes to the Privacy Policy: We will update this Privacy Policy as necessary to stay compliant with relevant laws. The updated version will be indicated by updating the "Effective Date" at the top of the Privacy Policy and the updated version will be effective as soon as it is accessible. We may use third-party software for internal activities such as communication. There is no specific app that we have tagged within our system but given the common practices, Zoho/Google Mail/Zoom is mostly used. Their terms of service and privacy policies can be referred at their respective websites. Again, this is subjective to the websites you engage with for different activities. If you click on one of the links to third party websites, you may be taken to websites we do not control. This Privacy Policy does not apply to the privacy practices of those websites. Please read the privacy policy of such other websites carefully. We are not responsible for these third-party sites.
We do not knowingly collect or solicit Personal Data from children under the age of 18 years and the Site and its content are not directed at children under the age of 18 years. In the event that we learn that we have collected Personal Data from a child under age 18 years without verification of parental consent, we will delete that information as quickly as possible. This page shall be construed in accordance with the provisions of Rule 3(11) of the Information Technology (Intermediaries Guidelines) Rules, 2011 that inter alia requires publishing the name of the Grievance Officer and his/her contact details on the Site, such that Users or any victim who suffers as a result of a violation of Rule 3 of the said Rules can notify their complaints to us.
